The mother is on the stand and just testified that there was no settlement.

That actually helps the prosecution.

She also has admitted to deleting things from the phone before giving it to the police, a felony.

A 3rd party committing crimes does not absolve the charged party - something I constantly have to convince my clients of.

Regardless of what did or didn't happen and whether or not it was illegal, the prosecution is fucked.

Who knows?  That's the big dice roll of trials, as juries can always do wacky ass things.  It's part of the reason why so many cases settle.

If getting paid off with a cash settlement in order to drop the lawsuit makes the accused look more guilty, then why does not having gotten a cash settlement help criminal prosecution?

Because juries don't like to hear that money changed hands with regards to post-process aspects of the case.  Sorta like when they hear how much expert witnesses get paid, or the like.

Not saying it logical, but again, some juries are mad.

In the end, they'll prolly cut him lose (or the judge simply gives a directed verdict, a very rare thing).

Smart money, of course, is that she's simply lying and they're taking the money and running.
